3. Contracting Process

3.1 Quote Request

Clients can request a quote through our contact form, email, or phone. We will provide a detailed proposal including project scope, estimated timelines, and pricing.

3.2 Quote Acceptance

Once the quote is accepted in writing (email or signed document), the contract is considered formalized. The client must pay the agreed deposit to start the project.

3.3 Delivery Timelines

Delivery timelines will be specified in each proposal. Times may vary depending on project complexity and timely delivery of materials by the client.

4. Pricing and Payment Methods

4.1 Pricing

All prices are expressed in euros (EUR) and do not include VAT, unless otherwise indicated. Prices shown on the website are indicative, and the final price will be determined in the customized quote.

4.2 Payment Methods

We accept the following payment methods:

• Bank transfer
• Credit/debit card
• PayPal

4.3 Payment Terms

Generally, we require 50% of the total price as a deposit to start the project, with the remaining 50% payable before final delivery. For large projects, milestone-based payments can be established.

5. Client Obligations

The client agrees to:

• Provide all information and materials necessary for the project.
• Respond to inquiries and approval requests in a reasonable time.
• Make payments as agreed.
• Ensure they have the necessary rights to the content provided.
• Review and approve work at established phases.

6. Creative BCN's Obligations

We commit to:

• Perform the agreed work with professionalism and diligence.
• Meet established deadlines, except in cases of force majeure.
• Maintain confidentiality of client information.
• Provide technical support during the agreed period.
• Deliver the project according to agreed specifications.

7. Intellectual Property

7.1 Client's Property

The client retains all rights to the materials they provide (texts, images, logos, etc.).

7.2 Creative BCN's Rights

Once full payment is completed, Creative BCN will transfer to the client the usage rights for the design and development performed. Creative BCN reserves the right to use the project as a reference in its portfolio, unless otherwise agreed.

7.3 Code and Technology

Custom code developed for the project will be owned by the client. However, Creative BCN may reuse frameworks, libraries, and generic code in other projects.

8. Revisions and Modifications

Each project includes a specified number of revisions as detailed in the quote. Additional revisions will be billed at current rates. Significant changes in project scope will require a new quote.

9. Cancellation and Refunds

9.1 Cancellation by Client

The client may cancel the project at any time. However, the deposit is non-refundable, and hours of work completed up to the cancellation date will be billed.

9.2 Cancellation by Creative BCN

We reserve the right to cancel the project if the client repeatedly fails to meet their obligations. In such cases, work completed will be billed.

10. Warranty and Support

We provide a 30-day warranty after project delivery to fix any errors or bugs in the development. This warranty does not cover issues caused by modifications made by third parties or by the client.

11. Limitation of Liability

Creative BCN shall not be liable for indirect, incidental, or consequential damages arising from the use or inability to use the services. Our total liability shall be limited to the amount paid by the client for the services.

12. Applicable Law and Jurisdiction

These terms shall be governed by Spanish law. Any disputes arising from these terms shall be submitted to the courts of Barcelona, Spain.
